Terms & Conditions of Service
Decracon Driveways – Patterned Concrete & General Building Services
By engaging Decracon Driveways, you (the client) agree to the following terms of service, which outline the responsibilities, expectations, and protections for both parties.
1. Scope of Work
Decracon Driveways provides services including, but not limited to:
- Patterned concrete driveways and patios
- Decorative surfacing, cleaning and sealing.
- General groundwork and building services.
All work is based on quotes or specifications agreed between the client and Decracon Driveways. Any drawings or plans form part of this agreement.
2. Quotation Validity
- All quotations are valid for 30 days unless otherwise stated.
- Prices are subject to change based on material cost fluctuations beyond our control.
3. Payment Terms
To secure a booking and manage staged progress, the following payment structure applies:
1. Deposit – 10%
Payable upon booking to confirm your start date and order materials.
2. Start of Work – 40%
Due on the first working day on-site.
3. Concrete Pour Day – 40%
Payable on the day the concrete is laid.
4. Completion – 10%
Final balance due immediately upon completion of all agreed works.
Note:
- Payments can be made via bank transfer, cheque, or cash.
- Delayed payments may result in suspension of work and further charges.
- Deposits and payments are non-refundable once a work stage is complete or materialshave been committed.
4. Client Responsibilities
- Ensure clear, unrestricted access to the working area, including availability of water, electricity, and waste disposal.
- Secure necessary permissions (e.g. planning consent, neighbour notifications) before work begins.
- Remove vehicles, bins, or personal belongings from the work area unless otherwise agreed.
5. Delays & Site Conditions
While we strive to adhere to estimated schedules, timelines may be affected by:
- Adverse weather
- Supplier delays
- Unexpected ground or site conditions
We will communicate any changes promptly and work to minimise delays.
6. Liability & Insurance
- Decracon Driveways is fully insured with public liability cover up to £5,000,000.
- We take pride in delivering work to high standards; however:
- Our liability is limited to the total value of the agreed contract.
- We are not liable for consequential losses (e.g. delays, landscaping, or damage caused by pre-existing issues).
- The client is responsible for ongoing maintenance and aftercare.
7. Concrete Disclaimer
By its nature, concrete is a natural material and subject to the following characteristics, which do not constitute defects:
- Surface cracks (hairline) may occur as part of the curing process.
- Colour variation and texture changes can happen due to weather, mix, or timing.
- Cracking cannot be entirely prevented, but we take all reasonable steps to minimise it (e.g., proper control joints, curing practices).
We cannot guarantee a completely crack-free surface and disclaim liability for natural shrinkage, surface crazing, or aesthetic variations beyond our control.
8. Materials & Changes
- All materials used will be of suitable quality and as specified.
- In the event of availability issues, equivalent substitutions may be used with client approval.
- Any changes to scope, materials, or layout must be agreed in writing and may affect the final price and timeline.
Ground Conditions Disclaimer
All quotations assume the removal of up to 7 inches (approx. 175mm) of existing ground, including top layers such as tarmac, paving, or compacted base.
If, upon excavation, it is discovered that:
- There is an unexpected second or deeper driveway layer,
- Additional excavation is required beyond the quoted depth, or
- Extra waste disposal is needed due to unforeseen materials,
then Decracon Driveways reserves the right to charge additional costs to reflect the extra
time, labour, and waste disposal incurred.
These conditions are impossible to fully assess until ground is opened, and clients will be informed immediately if this situation arises.
9. Cancellation
- Clients must provide at least 7 days' notice for cancellation or postponement.
- Decracon Driveways reserves the right to retain deposits to cover incurred costs of materials already ordered.
10. Disputes
We encourage open and fair communication. In the event of a dispute:
- Please raise the issue in writing within 14 days of completion.
- We will make every effort to resolve the matter amicably.
- If resolution is not possible, the issue may be referred to a neutral mediator or governed by small claims proceedings in England and Wales.
11. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
